The Brazilian Federal Law nº 101, enacted into law on May, 4th of 2000, known as well as the Fiscal Responsibility Law, introduced new important mechanisms in order to enforce transparency and responsibility as managing financial public resources. The current paper analyzes the instruments regarding the control of mandatory spending: a compensation instrument, drawn upon the American pay-as-you-go system introduced by the Budget Enforcement Act and later amendments, and an exhibit of mandatory spending expansion margin. The assessment of mandatory spending historic data for the Federal Government shows that the effectiveness of the proposed instruments has been strongly affected, therefore, refraining public managers, from directing financial resources to more efficient applications that could enforce long-term sustainable development. The paper also presents the current debate about the concepts regarding mandatory spending, the compensation mechanisms and the original goal concerning the obligation to present an exhibit of mandatory spending expansion margin. As a result, it indicates the urgency to review all of them, based on the original fundaments of the Brazilian Fiscal Responsibility Law. At last, it proposes a new model for the presentation of the exhibit of the estimated mandatory spending margin, by employing proper terms and the identification of values for the parameters used to preview revenues and expenditures.
