The objective of this study was to understand how, with a focus on separation and independence of powers, the relationship between executive and legislative branches in Brazil after the promulgation of the 1988 Constitution. From the perspective of the House of Representatives, it was observed, based on observation of the constitutional and regimental, that the internal organization of Congress focuses on the decisions of party leaders, and that for presidential initiatives are to succeed, the President of Republic is obliged to form coalitions with legislators, who are maintained on the basis of negotiating positions and by the release of budget amendments. Based on hypotheses from theories (in particular the issue of public policy, the electoral connection and electoral cycles), it was found that in some cases the interests of lawmakers prevail, despite the great presidential coalition. The methodology used was the analysis of provisional measures rejected in the period 2001 to 2010. At the end, it was concluded that the decision power of the President is not inherent in its legislative prerogatives, but due to the consent of parliament, especially the party leaders.
