Ascensão do judiciário e tensão institucional : judicialização, ativismo e reação do poder legislativo (PEC 33/2011)

Abstract

Analisa questões sobre a judicialização dos conflitos e o ativismo judicial, bem como aspectos referentes à Proposta de Emenda Constitucional (PEC 33/2011) que visa alterar dispositivos do texto magno a fim de aumentar ou criar o controle do Legislativo sobre algumas das decisões do Supremo Tribunal Federal.

Questions concerning the legalization of conflicts and judicial activism are quite recurrent in contemporary constitutional and institutional debates. However, the problem is not new and dates back to the strengthening of the exercise of constitutional jurisdiction. Recently, it was formulated in the Brazilian National Congress a proposition of constitutional amendment (PEC 33/2011) which aims to change some devices in the constitutional text to increase, or create, some would say, the control of the Legislature about some of the decisions of the Brazilian Supreme Court (STF).
