O sobrestamento de pauta no processo legislativo

Abstract

Estudo descritivo, desenvolvido sob o enfoque do novo institucionalismo, que trata do sobrestamento de pauta resultante da aplicação das regras constitucionais e regimentais. Busca identificar as razões da gênese desse instituto no presidencialismo brasileiro, assim como entender seu papel tanto na tramitação das proposições para as quais foi concebido, quanto nos trabalhos dos Plenários das Casas do Congresso Nacional. Procura compreender os mecanismos por meio dos quais o sobrestamento de pauta, além de garantir a apreciação célere de algumas proposições consideradas urgentes, contribui decisivamente para transformar o chefe do Poder Executivo no principal controlador da agenda do processo legislativo brasileiro.

This work is a descriptive study, developed under the approach to the new institutionalism and will be on the subject of the suspension of the schedule in the parliamentary agenda resulted of the application of constitutionals and internal parliamentaries rules. Here, we look for to identificate the reasons of the genesis of this institute in the brazilian presidentialism, and, also, understand its role in the processing of the proposals for which it was conceived, as in the works of the National Parliament Houses Plenaries. During the research, we tried to comprehend the mechanisms by which the suspension of the legislative schedule, besides standing surety for the swift valuation of some propositions considered pressing, has a crucial contribution in the transformation of the Executive Power Head in the main agenda setter of the brazilian legislative process.
