A redação final de proposições submetidas à apreciação do plenário da Câmara dos Deputados : as consequências da votação da redação presumida

Abstract

Analisa o fenômeno da má redação das leis sob a ótica do processo legislativo, a partir do exame das etapas de elaboração e de votação da Redação Final das proposições sujeitas à apreciação do Plenário da Câmara dos Deputados. O objetivo é verificar se as incoerências textuais, de forma e de conteúdo, são ocasionadas também pela votação da redação presumida, a par da inobservância das regras e preceitos de Técnica Legislativa. O trabalho mostra que a prática da votação da redação presumida pode provocar lapsos e incoerências no texto final, pelo encerramento da apreciação da matéria sem a possibilidade de sanear erros materiais ou formais porventura existentes. Além disso, propõe que a própria legitimidade do processo e, por conseguinte, do ato legislativo final, estaria maculada, pela impossibilidade de se atestar a conformidade entre a Redação Final e o real conteúdo deliberado pelo Plenário, podendo o texto não espelhar a real intenção do legislador. O trabalho inicia com as noções de Técnica Legislativa, de forma a caracterizar a importância do aspecto formal e da adequada apresentação escrita das proposições legislativas. Em seguida, descreve o atual processo de elaboração e de votação da Redação Final e as suas consequências para a redação e a legitimidade dos textos legais. Para isso, foram analisadas diversas Questões de Ordem acerca do assunto e realizada uma breve pesquisa, que contempla as proposições aprovadas pelo Plenário neste ano de 2011 (até 26/10/11), para verificar a quantidade de modificações introduzidas e a possibilidade de ocorrência de deficiências redacionais em razão da não apresentação do texto da Redação Final antes de considerá-lo definitivamente aprovado. Na sequência, faz um estudo de caso do processo de votação da Lei da "Ficha Limpa". Por fim, apresenta proposta de modificação, no sentido de contribuir para o debate e consequente aperfeiçoamento do referido processo.

This work analyzes the phenomenon of bad law texts in the legislative process. In the beginning, a brief description of the elaboration steps as well as the vote on the final text of the propositions subject to appreciation by the House Floor in the Brazilian Chamber of Deputies. Our aim is to verify if the inconsistencies in the text both in form and meaning are due to the vote using presumed text as well as the non observation of rules and requirements of legislative techniques. This study shows that the use of presumed text can produce gaps and incoherencies in the final text due to the finalization of the approved text without the possibility of further corrections of material and/or formal mistakes. It suggests that the legitimacy of the process itself and therefore of the final legislative act could be tainted due to the incapacity to certify the conformity between the final text and the real content which was deliberated by the House floor and so the text might not show the actual aim of the legislator. The study starts with notions on legislative techniques in order to prove the importance of the formal aspect and of the correct form of writing of legislative propositions. It then proceeds to describe the elaboration process itself and the vote of the final text and their consequences on the compositions and on the legitimacy of legal texts. Many debate topics were analyzed on the subject and a research was made on approved propositions by the House floor during 2011 (up to 10/26/11), in order to verify the amount of changes made and the possibility of the existence of composition differences due to the non presentation of the final text before it is finally approved. Lastly, to make the case study on the vote of the "Ficha Limpa" (Clean Record) Law. Finally, this study presents a proposition in order to contribute to the debate and therefore improve the whole process in itself.
