During the 1980's, the urban question in Brazil gained visibility as a national problem because of the occupation process of vacant buildings in the countries' major cities. In that period, two important movements converged: urban reform and redemocratization. Taking into consideration the Constitutional Process before 1988, popular movements¿ importance in the institutional sphere was highlighted, especially because the proposal of Emenda Popular da Reforma Urbana (Urban Reform Popular Amendment), converted into a manifesto for those involved. After the new Constitution promulgation, the urban reform movement celebrated the fact that, for the first time in the Brazilian Constitutional history, the theme was considered. The chapter about urban policies, however, required regulamentation to achieve practical efects, what was obtained with the approval of the Estatuto da Cidade, in 2001. Based on these premises, the main purpose of this research is to develop an analysis about the urban reform popular movement in Brazil and its influence to draw the urban legislation since the Constitutional Process. The basic goal is to reflect about the Brazilian democratic model, considering that the popular participation has contributed for a democratic regime which advances in relation to the classic model of representative democracy settled in the Western world....
